This has been addressed by recent procedural changes allowing jurors to take notes and ask questions. Third, the jurors disagree about their memory for pieces of evidence.
One of the TAM jurors goes so far as to shop for a knife similar to the one used by the defendant, which he then brings to the jury room (this might constitute juror misconduct, but that's a subject for another post). Second, despite being told to base their decision solely on the evidence, jurors necessarily, and unavoidably, draw on their personal knowledge and experiences. TAM was originally written for television by Reginald Rose and broadcast live on September 20, 1954. As a jury researcher, how could I resist? Although I did not get a part, I still went to a performance, and I was struck by how powerful and instructive the play still is, more than 50 years after its premiere.
